Terms of Use

These Terms of Use govern your access to and use of the AiO Konnect websites, monitoring platform, and mobile application (collectively, the “Site”). By registering for or using the Site, you agree to be bound by these Terms of Use. If you do not agree, you must not use the Site. These terms constitute a contract between you and Ohk Energy Limited (“we”, “us”, “our”, “AiO Konnect”), a company registered in Ireland with company number 581337 and registered office at The Ridge, McGrath Road, Castleblaney, Co. Monaghan, A75 WY97, Ireland. Our VAT number is 3419323OH.

Nothing in these Terms of Use affects your statutory rights as a consumer under Irish law.

Eligibility

You must be at least 18 years of age to create an account and use the Site. By registering, you confirm that you meet this requirement. AiO Konnect does not knowingly permit registration by persons under the age of 18.

Account Registration

To use certain features of the Site, you must register for an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information to keep it accurate and complete
  • Keep your password confidential and not disclose it to any other person
  • Notify us immediately at support@aiokonnect.com if you suspect any unauthorised access to or use of your account

You are responsible for all activity that occurs under your account. AiO Konnect is not liable for any loss or damage arising from your failure to maintain the security of your account credentials.

Acceptable Use

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the Site in any way that violates applicable law or regulation
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Attempt to gain unauthorised access to any part of the Site, its servers, or any systems or networks connected to the Site
  • Interfere with or disrupt the operation of the Site or the servers or networks connected to it
  • Introduce any viruses, trojans, worms, or other malicious or technologically harmful material
  • Use the Site in any way that could damage, disable, overburden, or impair it

Service

We will make the Site available to you in accordance with any functional specifications that we make available on the Site.

Intellectual Property

The Site and all of its contents, including but not limited to software, text, graphics, logos, and images, are the property of AiO Konnect or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for your personal or internal business purposes only. You must not copy, modify, distribute, sell, or lease any part of the Site or its content without our prior written consent.

Links to Third-Party Websites

The Site may contain links to third-party websites. These links are provided for your convenience only. AiO Konnect has no control over the content of those sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. We encourage you to review the terms and privacy policies of any third-party websites you visit.

Disclaimer of Warranties

AiO Konnect makes no representations or warranties in connection with the Site beyond those required by law. You have statutory rights under Part 3 of the Consumer Rights Act 2022, including that we have the right to provide the digital services under these Terms of Use, that the digital service must conform to these Terms of Use, and be fit for all purposes for which digital services of the same type would normally be used. These statutory rights are not affected by this clause.

Limitation of Liability

Subject to the paragraph below, AiO Konnect’s liability to you for any loss or damage arising from your use of the Site shall be limited to the greater of (a) the amount paid by you for any paid services provided through the Site in the twelve months preceding the claim, or (b) €100. AiO Konnect shall not be liable for any (a) indirect, incidental, special, consequential, or punitive damages, or (b) any loss of profits or revenues, whether incurred directly or indirectly. Subject to the foregoing caps and limits, we may be liable for foreseeable losses arising from our breach of contract, negligence, or breach of statutory duty.

Nothing in these Terms of Use excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any breach of the terms implied by the Consumer Rights Act 2022; or (e) any other liability that cannot be excluded or limited by Irish law.

Changes to These Terms

AiO Konnect reserves the right to update or modify these Terms of Use. Where changes are material, we will notify you by email at least 30 days before the changes take effect, clearly explaining the nature of the changes and your right to terminate the contract before the changes apply. If you do not agree to the updated Terms, you may close your account during this notice period without penalty. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the updated Terms of Use. Non-material changes (such as corrections of typographical errors) may take effect immediately upon posting.

Termination

AiO Konnect may suspend or terminate your account and access to the Site: (a) immediately and without notice if you have materially breached these Terms of Use (including using the Site for unlawful purposes or engaging in conduct that endangers other users); (b) upon 14 days’ written notice for any other breach, provided you have failed to remedy the breach within that period; or (c) immediately if required to do so by law or regulatory authority. We will provide you with reasons for any suspension or termination, except where prohibited by law. You may close your account at any time by contacting us at support@aiokonnect.com. Sections of these Terms of Use that by their nature should survive termination will continue to apply.

Right of Withdrawal (Cooling-Off Period)

You have the right to withdraw from these Terms of Use within 14 days of the date on which you enter into them, without giving any reason. To exercise your right of withdrawal, you must inform us of your decision by a clear statement (for example, by email to support@aiokonnect.com or by post). You may use the model withdrawal form set out below, but it is not obligatory.

Use of Data

You agree that we may use data that is collected through your use of the Site in connection with our support of your use of any connected product, the provision of any services to you, in order for us to undertake research and development to improve our products and services, and for any reasonably connected commercial purpose. You agree that we may also disclose it to third parties in connection with these uses of data, and those third parties may also use such data for their own commercial purposes. Where we use or disclose your data and it incorporates personal data, we will process your personal data in accordance with our Privacy Statement.

Governing Law and Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of Ireland. If you are a consumer habitually resident in another EU/EEA Member State, you will also benefit from any mandatory provisions of the consumer protection laws of that Member State. Any disputes arising out of or in connection with these Terms of Use shall be subject to the non-exclusive jurisdiction of the courts of Ireland, without prejudice to your right to bring proceedings in the courts of your country of residence.

Complaints Procedure
